Welcome to casenario.com (“Site”). These Terms & Conditions (“Terms”) govern your access to and use of the Site and our products and services (“Services”). By using the Site, you agree to these Terms and our Privacy Policy, Shipping Policy, and Refund & Returns Policy (together, the “Policies”).

1) Who we are

“Casenario,” “we,” “us,” and “our” refer to the owner/operator of the Site. Our Services include the sale of custom and non-custom phone cases and related accessories.

2) Eligibility & Account

•You must be at least 16 to use the Site and 18 to place orders (or the age of majority in your jurisdiction).

•Keep your account credentials confidential and accurate. You’re responsible for all activity under your account.

3) Ordering, Pricing & Payment

•Placing an order is an offer to buy. We may accept or reject orders (e.g., for suspected fraud, content violations, or stock issues).

•Prices are shown in USD and may change without notice. Taxes, duties, and shipping are calculated at checkout.

•We reserve the right to correct typographical or pricing errors; if an error affects your order, we’ll notify you and you may cancel or reconfirm.

•We accept payment methods shown at checkout. Your card is charged at order placement or when production begins.

4) Customization Content & License

You may upload images, text, graphics, logos, or other materials (“User Content”) for customization.

You represent and warrant that:

•You own or have permission to use all rights in the User Content;

•The User Content does not infringe intellectual property, privacy, or publicity rights;

•The User Content is lawful, not hateful/harassing, pornographic, or otherwise prohibited.

License you grant us: You grant Casenario a limited, non-exclusive, royalty-free license to use, reproduce, modify, and display the User Content solely for: order preview, production, quality control, customer service, and legal compliance. We will not use your User Content for advertising or portfolio without your additional consent.

We may reject or cancel any order containing prohibited or questionable content.

5) Production & Color/Trim Tolerances

•Typical production time for custom items is 1–3 business days after order confirmation (see Shipping Policy for details).

•Due to screen differences and print processes, minor color variation is normal.

•For full-bleed designs, allow reasonable trim tolerance; keep key elements within the safe area in the editor.

6) Shipping, Risk of Loss & Delivery

•Shipping options, fees, and thresholds are set out in our Shipping Policy (e.g., US orders over $39.90 ship free; under $39.90 = $5 flat).

•Delivery times are estimates and may vary due to carrier or customs delays.

•Risk of loss passes to you upon carrier’s delivery scan to your address. Ask us about signature-required services before shipping if needed.

7) Returns, Refunds & Cancellations

•Our Refund & Returns Policy applies. In short:

•Non-custom items: 14-day returns (unused, original packaging). Return postage is typically the customer’s responsibility.

•Custom/personalized items: Non-returnable except for quality issues or damage upon arrival.

•You may request order changes/cancellation before production starts for custom items. Once printing begins, cancellation isn’t possible.

8) Promotions, Coupons & Gift Cards

•One promotion or coupon per order unless stated otherwise.

•Promotions are subject to change or cancellation without notice and may exclude certain products or shipping methods.

•Gift cards are non-refundable except as required by law.

9) Intellectual Property (Site Content)

All Site content—designs, text, graphics (excluding User Content), trademarks, logos, and software—is owned by or licensed to Casenario and protected by IP laws. You may not copy, modify, distribute, or create derivative works without permission.

10) Acceptable Use

You agree not to:

•misuse the Site, interfere with security, or attempt unauthorized access;

•upload malware or automate access (scraping, robots) without our written consent;

•use the Services for unlawful purposes or to infringe others’ rights.

We may suspend or terminate access for violations.

11) Third-Party Services & Links

We may use third-party services (payment processors, carriers, analytics) and link to external sites. Their terms and privacy policies govern those services; we are not responsible for third-party content or practices.

12) DMCA / IP Complaints

If you believe content on the Site infringes your copyright or trademark, email support@casenario.com with: your contact info; identification of the work/mark; the location of the allegedly infringing material; a statement of good-faith belief; and a statement, under penalty of perjury, that your notice is accurate and you are authorized to act.

13) Warranties & Disclaimers

The Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or that defects will be corrected.

14) Limitation of Liability

To the maximum extent permitted by law, Casenario and its affiliates will not be liable for: (a) indirect, incidental, special, consequential, or punitive damages; or (b) any amount exceeding the total fees you paid to Casenario for the order giving rise to the claim. Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the minimum extent required by law.

15) Indemnification

You agree to indemnify and hold harmless Casenario and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your: (a) use of the Services; (b) User Content; (c) violation of these Terms or applicable law; or (d) infringement of any rights of a third party.

16) Governing Law & Dispute Resolution

•Governing law: These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, unless the laws of your domicile require otherwise.

•Informal resolution first: Contact us to try to resolve any dispute within 30 days.

•Arbitration (U.S. users): Except for small-claims or injunctive relief, disputes will be resolved by binding individual arbitration under the rules of the American Arbitration Association in English, in Los Angeles County, California. Class actions are waived.

•Opt-out: You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing support@casenario.com with subject “Arbitration Opt-Out” and your name, account email, and a statement that you opt out.

•If arbitration is unenforceable, disputes will be heard in the state or federal courts in Los Angeles County, California, and you consent to jurisdiction there.

17) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, labor disputes, war, pandemics, power or Internet interruptions, carrier/courier failures).

18) Changes to the Services or Terms

We may update products, pricing, or features at any time. We may change these Terms by posting an updated version with a new “Last updated” date. Material changes will be reasonably highlighted; your continued use after changes constitutes acceptance.

19) Severability & Assignment

If any provision is unenforceable, the remainder remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or asset sale.

These Terms, together with the Policies referenced above, constitute the entire agreement between you and Casenario regarding the Services and supersede prior or contemporaneous agreements on the same subject.
